A former Minister of Finance, Ken Ofori-Atta, has filed a lawsuit against two National Security operatives. He describes the situation as trespass. He also claims it is a violation of his right to privacy after an alleged raid on his residence.
The writ was filed at the Accra High Court on Monday, March 10. It is based on an incident on February 11, 2025. During this incident, individuals believed to be National Security operatives allegedly raided Mr Ofori-Atta’s Cantonments residence in Accra.
The suit names two senior police officers, DSP Bismark Boakye Ansah and Chief Inspector Mensah, as defendants. In his statement of claim, Mr Ofori-Atta contends that the raid was carried out without prior notice or legal justification.
He stated that the raiding team did not produce any form of warrant. They also did not indicate to his domestic staff the basis for the search. However, he warned them to desist from using mobile phones throughout the entire period of the unauthorised operation.
He further asserts that the raid left his domestic staff traumatised, causing them to suffer varying degrees of severe shock.
The former Finance Minister also stated something notable. The National Intelligence Bureau (NIB), the Chief of Defence Staff, and the Inspector General of Police have not provided confirmation. They have not confirmed whether the operatives acted under their directives.
He added that as a result of the incident, he has suffered great anxiety. He also endured distress, which led to significant loss and damage.
Mr Ofori-Atta is asking the court to declare that the entry and search of his residence constituted trespass. It was also a breach of his right to privacy.
He is seeking damages for trespass and breach of privacy. He also wants a perpetual injunction. This injunction would restrain the defendants or their agents from conducting any similar operation against him in the future.
The lawsuit is expected to test the limits of security operations. It will explore the rights of private citizens, especially those of former public officials.
